1. About QALA
QALA is an AI-powered landscape plan validation service operated by Alastair Cameron (ABN 13 299 746 702), trading as QALA ("we", "us", "our"). QALA is based in Perth, Western Australia.
Our service allows landscape architecture professionals to upload PDF landscape plans for automated compliance checking against common industry standards. We generate validation reports highlighting potential issues for professional review.
2. Acceptance of Terms
By creating an account, accessing, or using the QALA service at qala.com.au ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.
3. Account Registration
- You must provide a valid email address and create a password to register.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must be at least 18 years of age to create an account.
- You are responsible for all activity that occurs under your account.
- One account per person or entity. Do not share accounts.
4. Service Description
QALA provides automated AI-based analysis of landscape plan PDFs. The Service:
- Checks plans against common landscape architecture documentation standards
- Generates validation reports identifying potential issues, errors, or omissions
- Provides a compliance score and detailed per-item findings
5. Important Disclaimers
QALA reports are provided as an automated quality assurance tool only.
- Not a substitute for professional review. QALA does not replace the judgement of a qualified landscape architect, certifier, or relevant authority.
- Not a certification. A QALA report does not certify that a plan is compliant with any specific regulation, standard, council requirement, or building code.
- Not professional advice. QALA outputs should not be treated as legal, engineering, planning, or architectural advice.
- AI limitations. The Service uses artificial intelligence and optical character recognition (OCR) which may produce errors, miss issues, or generate false positives. Results should always be verified by a qualified professional.
- No guarantee of accuracy. While we strive for accuracy, we do not guarantee that all issues in a plan will be detected, or that all reported issues are genuine errors.
6. Credits and Payments
- The Service operates on a credit-based system. Each plan validation consumes one credit.
- New accounts receive one (1) free credit upon registration.
- Additional credits can be purchased via our website. All payments are processed securely through Stripe.
- Promotional codes may be offered from time to time at our discretion, with specific terms attached to each code.
- All prices are in Australian Dollars (AUD).
- Credits do not expire unless otherwise stated at the time of purchase or promotion.
7. Refund Policy
- Credits are non-refundable once used (i.e., once a validation has been initiated).
- If a validation fails due to a system error (not a plan quality issue), we will re-credit your account at our discretion.
- Unused purchased credits may be refunded within 30 days of purchase by contacting us at reports@qala.com.au.
- Subscription plans may be cancelled at any time. Access continues until the end of the current billing period. No pro-rata refunds for partial months.
- We comply with the Australian Consumer Law. Nothing in these terms limits your rights under that law.
8. Acceptable Use
You agree not to:
- Upload content that is illegal, harmful, or infringes on intellectual property rights
- Attempt to reverse-engineer, decompile, or extract the underlying algorithms or models
- Use the Service to build a competing product or service
- Share, resell, or redistribute your account access or credits
- Use automated tools to access the Service beyond its intended API
- Attempt to circumvent usage limits, access controls, or security measures
9. Intellectual Property
- Your content: You retain all rights to the landscape plans you upload. By uploading, you grant us a limited licence to process, analyse, and store the plan for the purpose of providing the Service.
- Our content: The QALA platform, algorithms, reports, branding, and all related intellectual property remain our property.
- Report outputs: Validation reports generated by QALA are licensed to you for your professional use. You may share reports with clients, councils, or colleagues.
10. Data Handling
Please refer to our Privacy Policy for details on how we collect, use, store, and protect your data.
In summary: uploaded plans are processed for validation purposes and stored securely. We do not sell your data or share your plans with third parties.
11. Limitation of Liability
To the maximum extent permitted by Australian law:
- QALA is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We do not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected.
- We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, reliance on its outputs, or inability to use the Service.
- Without limiting the foregoing, we are not liable for any loss, damage, cost, or expense arising from a development application rejection, council non-compliance finding, construction delay, or any other consequence of relying on a QALA report.
- Our total aggregate liability for any and all claims arising from or related to the Service is limited to the lesser of: (a) the amount you paid for credits in the 12 months preceding the claim, or (b) AUD $500.
- You acknowledge that QALA is an automated tool with inherent limitations, and you assume full responsibility for verifying all results with appropriate professional judgement before acting on them.
Nothing in these terms excludes or limits liability that cannot be excluded under Australian Consumer Law, including guarantees under Schedule 2 of the Competition and Consumer Act 2010 (Cth).
12. Indemnification
You agree to indemnify, defend, and hold harmless QALA, its operator, and any related parties from and against any and all claims, demands, damages, losses, costs, liabilities, and expenses (including reasonable legal fees) arising from or related to:
- Your use of the Service or reliance on QALA reports
- Your breach of these Terms of Service
- Your violation of any applicable law or regulation
- Any claim by a third party arising from your use of QALA reports (including but not limited to claims by your clients, councils, contractors, or regulatory authorities)
- Any content you upload to the Service, including claims of intellectual property infringement
This indemnification obligation survives the termination of your account and these Terms.
13. Termination
- You may close your account at any time by contacting us at reports@qala.com.au.
- We may suspend or terminate your account if you breach these terms, with or without notice.
- On termination, your right to access the Service ceases immediately. Unused credits are forfeited unless a refund is issued under Section 7.
- We will retain your data in accordance with our Privacy Policy. Account data will be deleted within 90 days of a deletion request. Payment records are retained for 7 years as required by Australian tax law.
- Sections 5, 11, 12, and 14 survive termination of your account and these Terms.
14. Dispute Resolution
- Informal resolution first. Before initiating any formal proceedings, you agree to contact us at reports@qala.com.au and attempt to resolve the dispute informally for at least 30 days.
- Mediation. If informal resolution fails, either party may refer the dispute to mediation administered by the Resolution Institute (resolution.institute) in Perth, Western Australia before commencing litigation.
- Governing law. These terms are governed by the laws of Western Australia, Australia.
- Jurisdiction. Subject to the dispute resolution process above, any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
15. Force Majeure
We are not liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, government actions, internet or telecommunications failures, third-party service outages (including cloud hosting, AI providers, or payment processors), cyberattacks, or power failures.
16. General Provisions
- Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and QALA regarding the Service and supersede all prior agreements or understandings.
- Severability. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
- Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
- Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
- Notification of changes. We will notify you of material changes to these Terms by email at least 14 days before they take effect. For non-material changes, updated terms will be posted on this page. Continued use of the Service after the effective date constitutes acceptance.
